In my “Black Education Disaster” column (12/22/10), I presented National Assessment of Educational Progress test data that demonstrated that an average black high school graduate had a level of reading, writing and math proficiency of a white seventh- or eighth-grader. As of this moment Obamacare is officially not the law of the land. As Federal Judge Roger Vinson ruled on Monday in Florida, “[T]here is a long standing presumption that officials of the Executive Branch will adhere to the law as declared by the court. As a result, the declaratory judgment is the functional equivalent of an injunction.” That law as declared by the Federal District Court in Florida is now that Obamacare is unconstitutional.

The federal court in the massive 26-state challenge to ObamaCare on Monday held that the health care law’s individual mandate is unconstitutional. And, even more importantly, the judge accepted the argument in my court brief that the mandate cannot be separated from the rest of this 2,700-page legislative monstrosity, and struck down the entire law.

It’s a positive sign of the times that constitutional expert Mike Lee of Utah was elected to the U.S. Senate.
