In my “Black Education Disaster” column (12/22/10), I presented National Assessment of Educational Progress test data that demonstrated that an average black high school graduate had a level of reading, writing and math proficiency of a white seventh- or eighth-grader. As of this moment Obamacare is officially not the law of the land. As Federal Judge Roger Vinson ruled on Monday in Florida, “[T]here is a long standing presumption that officials of the Executive Branch will adhere to the law as declared by the court. As a result, the declaratory judgment is the functional equivalent of an injunction.” That law as declared by the Federal District Court in Florida is now that Obamacare is unconstitutional.
